Terms of Use
These Terms of Use ("Terms") are an agreement between you and TechEscrow ("TechEscrow", "we", "us") for the use of the website techescrow.in and any related services (the "Platform"). By creating an account or using the Platform you accept these Terms, our Privacy Policy, Refund & Dispute Policy, Shipping & Delivery Policy and Prohibited Items & Conduct page. Sellers also accept the Seller Agreement. If you do not agree, please do not use the Platform.
1. What TechEscrow is
TechEscrow is an online marketplace where individuals and businesses ("Sellers") list used computer parts and other eligible items, and other users ("Buyers") buy them. TechEscrow is an intermediary. We provide the technology that lets Buyers and Sellers meet, negotiate, pay and arrange delivery. The contract of sale for a part is between the Buyer and the Seller. We do not own, inspect, repair or warrant the parts listed, and we are not the seller of any part.
We do provide a payment protection service: the Buyer's payment is collected and held by our licensed payment partner, and it is released to the Seller only after the Buyer confirms the part works or the 48-hour test window ends without a problem being reported. This is explained in section 7 and in the Refund & Dispute Policy.
2. Eligibility and your account
- You must be at least 18 years old and able to enter into a binding contract under Indian law.
- You must register with a valid email address and phone number, and verify the email address. Sellers must also complete identity and bank verification (KYC) before listing.
- The information you give us must be true, complete and kept up to date. You may hold one account.
- You are responsible for keeping your password confidential and for all activity under your account. Tell us at once at support@techescrow.in if you suspect unauthorised use.
3. How a purchase works
- Chat. A Buyer starts a conversation with the Seller from the listing page. Direct purchase without a conversation is not offered.
- Offer and price. A Buyer may send a price offer. A Seller may accept, reject or counter it. An offer must be between the minimum percentage of the asking price shown in the chat and the asking price itself, and it expires after the period shown in the chat if it is not answered. When an offer is accepted, or when a Buyer chooses Buy now on a listing that allows it, the price is locked and the part is reserved for that Buyer.
- Payment. A secure payment link for that Buyer appears in the chat. The Buyer must pay before the payment deadline shown on the order, otherwise the order is cancelled and the part is available to other Buyers again.
- Pickup and delivery. After payment we arrange a courier pickup from the Seller and delivery to the Buyer (see the Shipping & Delivery Policy).
- Test window. The Buyer has 48 hours from delivery to test the part and either confirm it works or report a problem.
- Release. If the Buyer presses Confirm Works, or the 48 hours end without a report, the Seller's payout is released. If the Buyer reports a problem, the payout is held while we review it.
4. Listings and Seller responsibilities
- A Seller must be the lawful owner of the part, or authorised to sell it, and must describe it accurately: model, condition, defects, age, warranty status, what is included, and the serial number where it has one.
- Photos must show the actual item. A Seller may not list the same part more than once or use another person's photos.
- Listings are reviewed before they appear. We may reject, remove or edit a listing that does not meet our rules, at our discretion.
- A Seller must pack the part securely and hand it to the courier within the time we communicate once the Buyer has paid.
5. Conduct in chat and on the Platform
To protect both sides, all communication and payment for a deal must stay on the Platform. You must not:
- share or ask for phone numbers, email addresses, social media handles, UPI IDs, bank details or links in chat to take the deal elsewhere. Our systems may block such messages;
- ask for or make any payment outside TechEscrow for a part listed here;
- harass, threaten or abuse another user, or send spam;
- list prohibited items or break any law (see Prohibited Items & Conduct);
- attempt to interfere with, scrape, reverse-engineer or overload the Platform, or access another user's account or data.
Repeated blocked messages can pause your ability to chat for a period.
6. Prices, fees and taxes
- The price shown on a listing is the price of the part. Used goods sold by individuals are sold between the Buyer and Seller; we do not add GST to the part price.
- Buyer Protection Fee: 3% of the price of the part, charged to the Buyer at checkout, plus GST at 18% on that fee.
- Seller commission: 5% of the price of the part, deducted from the Seller's payout, plus GST at 18% on the commission.
- Shipping and insurance: calculated from the weight and value of the part and shown to the Buyer before payment.
- Where the law requires tax to be deducted or collected at source on a transaction, we will do so and show it in the Seller's payout breakdown.
- Every amount is shown on the order summary before the Buyer pays. Fee rates may change; the rates shown at the time an order is created apply to that order.
- Each user is responsible for their own tax obligations arising from their purchases and sales.
7. Payments and payment protection
Payments are processed by a payment partner that is authorised to do so under Indian law. TechEscrow does not store your card, UPI or bank login details. Funds collected for an order are held for the Seller until the order reaches a release condition (confirmation by the Buyer, expiry of the test window, or a decision on a dispute). Funds are paid to the Seller's verified bank account in their own name. A Seller who changes their bank details is subject to a security hold before payouts to the new account begin.
8. Cancellations and refunds
An order that is not paid in time is cancelled automatically. After payment, a Buyer's remedies are described in the Refund & Dispute Policy. A Seller may not cancel a paid order except in the circumstances allowed in the Seller Agreement.
9. Disputes between users
If a Buyer reports a problem within the test window, we review the information and evidence from both sides and decide whether the Buyer should be refunded or the Seller paid. Our decision on how the held funds are paid out is final as far as the Platform is concerned. It does not prevent either party from pursuing other remedies available under law.
10. Suspension and termination
We may warn, restrict, suspend or close an account, remove listings, or withhold payouts where we reasonably believe a user has broken these Terms, committed or attempted fraud, put others at risk, or where the law requires it. You may close your account at any time by writing to us, once any open orders are complete. Closing an account does not affect rights and obligations that have already arisen.
11. Content and intellectual property
The Platform, its design, software and branding belong to us or our licensors. By uploading photos, descriptions or messages, you confirm you have the right to do so and grant us a non-exclusive, royalty-free licence to display and use that content on the Platform for operating and promoting the service. You remain the owner of your content.
12. Disclaimers
Parts are used and are sold by Sellers on an "as described" basis. We do not guarantee the condition, performance, authenticity or fitness of any part, or the accuracy of any listing, beyond the protection described in the Refund & Dispute Policy. The Platform is provided "as is" and "as available". We do not guarantee that it will be uninterrupted or error-free.
13. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect or consequential loss, loss of profit or loss of data arising from your use of the Platform, or for the acts or omissions of Buyers, Sellers, couriers or other third parties. Our total liability to you for any claim relating to an order is limited to the amount you paid or were due to receive for that order. Nothing in these Terms limits any liability that cannot be limited under applicable law, including your rights as a consumer.
14. Indemnity
You agree to compensate us for losses, claims and costs (including reasonable legal fees) arising from your breach of these Terms, your listings or content, or your violation of any law or third-party right.
15. Changes to these Terms
We may update these Terms from time to time. We will post the new version on this page with a new "last updated" date and, for material changes, notify registered users by email. Orders already created continue on the terms that applied when they were created. Continued use after a change means you accept it.
16. Governing law and disputes with us
These Terms are governed by the laws of India. Subject to any rights you have as a consumer under law, the courts at Gurugram, Haryana have jurisdiction over disputes arising from these Terms. Before going to court, please try to resolve a complaint with us through our Grievance Officer.
